End User Licence Agreement
This agreement governs your use of Lucerna. It is written to be read, not to bury things.
Effective date: April 25, 2026
This End User Licence Agreement (“EULA”) is a legal agreement between you (“Licensee”) and Luminos Film S.r.l. (“Licensor”), a company registered in Italy, for the use of Lucerna (“the Software”). By installing or using the Software, you accept this EULA. If you do not accept it, do not install or use the Software.
This EULA supplements the Mac App Store Terms of Service. Where there is a conflict, the Mac App Store Terms govern.
1. Grant of licence
Licensor grants you a personal, non-exclusive, non-transferable, perpetual licence to install and use the Software on any Apple-branded hardware you own or control, running a compatible version of macOS, in accordance with this EULA and any usage rules set by the Mac App Store.
2. Permitted use
You may:
- Use the Software for personal or commercial screenwriting and film production purposes.
- Install the Software on multiple Macs you own or control, subject to Mac App Store family sharing terms.
- Export and distribute content you create using the Software. Your content is not encumbered by this licence.
3. Restrictions
You may not:
- Copy, modify, or distribute the Software or any portion of it, except as expressly permitted here.
- Sublicense, sell, resell, rent, lease, or otherwise transfer rights to the Software.
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent permitted by applicable law.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
- Use the Software to develop a product that competes with Lucerna without express written consent.
4. Ownership
The Software is licensed, not sold. Luminos Film retains all intellectual property rights in and to the Software, including all updates, modifications, and derivative works. This EULA grants you no rights to Luminos Film’s intellectual property other than the licence described above.
Your content remains yours. The Software does not transfer, acquire, or claim any rights over files, scripts, or data you create using it.
5. Updates and maintenance
Software updates distributed through the Mac App Store are provided at no additional charge and are subject to this EULA. Major version upgrades may require a separate purchase. We will communicate this clearly before any such upgrade is offered.
6. Privacy
The Software is designed to operate without collecting your personal content. Where data processing does occur (anonymous telemetry, libp2p relay IP routing), it is described in our Privacy Policy at lucerna.app/legal/privacy. The Privacy Policy forms part of this agreement.
7. Warranty disclaimer
To the maximum extent permitted by applicable law, the Software is provided “as is” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Luminos Film does not warrant that the Software will be error-free or uninterrupted.
Nothing in this clause affects any statutory rights you may have as a consumer under Italian or EU law.
8. Limitation of liability
To the maximum extent permitted by applicable law, Luminos Film’s total liability to you for any claims arising out of this EULA or your use of the Software does not exceed the amount you paid for the Software in the twelve months preceding the claim. Luminos Film is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill.
Nothing in this EULA excludes or limits Luminos Film’s liability where it cannot be limited under applicable law (including liability for death or personal injury caused by negligence, fraud, or mandatory consumer protection provisions).
9. Termination
This EULA is effective until terminated. It terminates automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession. Provisions that by their nature should survive termination will survive.
10. Governing law and jurisdiction
This EULA is governed by the laws of Italy. Any disputes arising out of or relating to this EULA are subject to the exclusive jurisdiction of the courts of Turin, Italy, except where applicable EU consumer law provides that you may bring proceedings in the courts of your country of residence.
11. Entire agreement
This EULA, together with the Privacy Policy and the Mac App Store Terms of Service, constitutes the entire agreement between you and Luminos Film regarding the Software and supersedes all prior agreements.
